CONSUMER NOTICE

 The Federal Court of Appeals for the 7th Circuit ruled in the cases  of Moore I, II, and III that cemeteries cannot prohibit the purchase  of markers from an outside provider. Furthermore, it ruled that  cemeteries cannot prevent a marker purchased from an outside  source from being installed if it meets the reasonable rules  and regulations of the cemetery. Lastly, a cemetery may only  charge a fair fee for the installation of a marker purchased  elsewhere. The practice of charging installation exclusively  for markers purchased outside the cemetery is an illegal tie-in  and is a violation of federal anti-trust laws under the Sherman Act.

Although the vast majorities of cemeteries deal with family members in an ethical manner, there are always a few exceptions. If you encounter any problem with your cemetery over the purchase of your marker, we encourage you to stand up for your rights as a consumer and file a complaint against the cemetery with the Federal Trade Commission using this online complaint form.
